2. Agreement to These Terms
By downloading, installing, registering for or using any part of the Platform you agree to be bound by: (a) these T&Cs; (b) our Privacy Policy; and (c) any other policies, guidelines or codes of conduct published in the App (collectively “Policies”).
If you do not accept the T&Cs, you must cease using the Platform immediately and uninstall the App.
3. Eligibility & User Accounts
- At least 18 years of age, or 16–17 with verifiable parental consent;
- Capacity to enter a legally binding contract; and
- Use of the Plfatform in accordance with all applicable laws.
You must provide accurate, current information and keep login credentials secure. You are responsible for all activity under your account.
TripiTask may suspend or terminate an account, or restrict features, where it reasonably believes a breach of these T&Cs or a risk to the Platform or other Users exists.
4. Nature of the Platform
TripiTask provides a neutral venue enabling Task Posters and Taskers to connect, communicate, form Service Contracts and process payments. TripiTask does not itself perform Tasks, supply goods, guarantee workmanship, nor assume any duty of care. Taskers act as independent contractors; no employment, partnership, joint-venture or agency relationship is created. Verification badges (if any) indicate documents were sighted at a point in time and are not endorsements or warranties.
5. Posting, Quoting & Acceptance
Task creation: Posters must provide a truthful description, location (or “remote”), budget, timeframe and any hazards or prerequisites. Selecting Urgent triggers instant notifications to nearby Taskers.
Offers: Taskers may submit revocable offers stating price, timing and inclusions until accepted in-App.
Formation of Service Contract: Acceptance in-App forms a Service Contract incorporating the listing, accepted offer terms, and chat variations. TripiTask is not a party to it.
6. Payments & Fees
Except as authorised otherwise, Posters must pre-authorise the Task amount (or first milestone) with the Payment Provider; funds are held in escrow until completion confirmation or dispute. On confirmation—or automatic release 48 hours after the Tasker marks “Completed” if the Poster takes no action—funds are released minus the Service Fee. Fees and card charges are disclosed before authorisation. Taskers are responsible for taxes; where GST applies, quote GST-inclusive prices and provide tax invoices on request.
7. Cancellations
- Before commencement, mutual cancellation in-App returns funds to the Poster less non-refundable card charges (subject to reasonable Tasker expenses agreed by the Poster).
- If a Tasker fails to attend, materially breaches, or performs unsafely, the Poster may cancel and seek a full refund.
- Frequent or unreasonable cancellations may result in account restriction or termination.
8. Insurance & Safety
Taskers must maintain appropriate insurance (e.g., public liability, professional indemnity, workers compensation, vehicle). Posters must provide a safe site and disclose hazards. TripiTask does not insure Users and is not liable for losses due to inadequate insurance.
9. Dispute Resolution
Resolve disputes via in-App chat first. If unresolved within three (3) calendar days after “Completed,” either party may escalate via the in-App dispute form. TripiTask may review evidence and propose a non-binding settlement; if both parties accept in-App, the Payment Provider is instructed accordingly. Parties may pursue external resolution thereafter; TripiTask need not participate unless required by law.
10. Ratings & Reviews
After completion, each party may rate and review. Reviews must be genuine, factual, and not defamatory, discriminatory, abusive or confidential. TripiTask may remove/redact reviews that breach these standards or a valid court order.
11. Acceptable Use
- Do not breach laws or industry codes;
- Do not post/accept unlawful, dangerous, fraudulent or unlicensed Tasks;
- No harassment, threats, defamation, or discrimination;
- No off-platform payments to evade Service Fees;
- No viruses, malware, hacking, scraping, or data mining;
- No bots/automation without prior written consent.
12. Intellectual Property
TripiTask™ trademarks, software, layouts and content are owned by or licensed to TripiTask Pty Ltd. Users get a personal, non-exclusive, revocable licence to use the Platform under these T&Cs. User-generated content remains yours; you grant TripiTask a worldwide, perpetual, royalty-free licence to host, reproduce, technically modify, communicate and display it for operating, promoting and improving the Platform.
13. Privacy
TripiTask handles personal information per the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By using the Platform you consent to processing as described in the Privacy Policy and to storage in Australia and reputable overseas jurisdictions with contractual safeguards.
14. Warranties & Non-Excludable Guarantees
Except for non-excludable guarantees under the ACL, the Platform is provided “as is” and “as available”; no warranty of uninterrupted, error-free or fitness for purpose. Nothing here excludes or limits any rights you have that cannot be excluded by law.
15. Limitation of Liability
To the maximum extent permitted and subject to clause 14.2, TripiTask is not liable for loss of profit, revenue, opportunity, goodwill, anticipated savings; indirect, consequential, special or punitive damages; or personal/property damage arising from Platform use, Service Contracts/Tasks, or acts/omissions of Users. For non-excludable guarantees, liability is limited to resupplying services or paying the cost of resupply. Aggregate liability in any rolling 12-month period is capped at the greater of AUD $100 or total Service Fees paid in that period.
16. Indemnity
You indemnify TripiTask and its officers, employees and related bodies corporate from claims, losses, costs (including reasonable legal fees) arising from your breach of these T&Cs/any Service Contract, violations of law/third-party rights, or negligent/reckless/wilful misconduct.
17. Suspension & Termination
TripiTask may suspend/restrict/terminate your account (and pending Tasks) on notice if it reasonably believes you breached T&Cs/Policies, engaged in fraud/misconduct/harm, or created risk/legal exposure. You may close your account anytime; licences, indemnities and unpaid obligations survive closure.
18. Third-Party Links & Services
The Platform may link to or integrate with third-party sites/services. TripiTask does not endorse or control them and is not responsible for their content, privacy practices or availability.
19. Modifications
TripiTask may amend these T&Cs by at least 14 days’ notice via email or in-App notification; continued use after the effective date constitutes acceptance. Features may change/suspend/discontinue at any time without liability.
20. Governing Law & Jurisdiction
These T&Cs are governed by the laws of Western Australia. Each party submits to the exclusive jurisdiction of the courts of that State and the Commonwealth courts sitting in it.
21. General
- Entire Agreement: These T&Cs, the Policies and any Service Contract formed via the Platform.
- Assignment: TripiTask may assign/transfer its rights/obligations without consent. You may not assign without prior written consent.
- Severability: Invalid provisions are severed; remainder continues.
- No Waiver: Failure to enforce is not a waiver.
- Interpretation: Headings are for convenience; “including” is not limiting.
